Terms of Service

1. Agreement to Terms

By accessing or using Postscale ("the Service"), you agree to be bound by these Terms of Service. Postscale is a transactional email infrastructure service operated by DNScale OÜ (registry code: 16776331), located at Harju maakond, Tallinn, Lasnamäe linnaosa, Sepapaja tn 6, 15551, Estonia.

If you do not agree to these terms, you may not use the Service. These terms constitute a legally binding agreement between you and DNScale OÜ.

2. Description of Services

Postscale provides the following email infrastructure services:

• Transactional email sending via REST API
• Inbound email receiving and webhook processing
• Masked email addresses for user privacy protection (Postscale Shield)
• Email delivery tracking (opens, clicks, bounces) via webhooks and dashboard
• Domain management with automated DNS verification (SPF, DKIM, DMARC)
• DKIM signing for authenticated email delivery

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials and API keys
• Be at least 18 years of age
• Comply with all applicable laws and regulations in your jurisdiction

You are responsible for all activity that occurs under your account and API keys.

4. Acceptable Use Policy

You agree not to use the Service to:

• Send unsolicited bulk email (spam) or messages that violate anti-spam laws (CAN-SPAM, GDPR, ePrivacy Directive)
• Distribute malware, phishing content, or fraudulent messages
• Send illegal, threatening, or harassing content
• Attempt to disrupt, overload, or interfere with the Service or its infrastructure
• Gain unauthorized access to other accounts or systems
• Violate intellectual property rights of third parties

Violation of this policy may result in immediate suspension or termination of your account without notice.

5. Service Levels and Availability

We target 99.9% uptime for our API and email delivery infrastructure. This excludes:

• Scheduled maintenance, for which we provide advance notice
• Emergency maintenance necessary for security or stability
• Events beyond our reasonable control (force majeure)

6. Pricing and Payment

• Paid plans are billed in advance on a monthly or annual basis
• All prices are in Euros (EUR) and subject to applicable VAT
• Payment is due within 14 days of invoice date
• Accounts with overdue payments may be suspended after 30 days
• Refunds are handled in accordance with our refund policy and applicable EU consumer protection laws

7. Data and Privacy

Our Privacy Policy is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

We process email data on your behalf as a data processor under GDPR. You remain the data controller for the personal data of your end users that is processed through our Service.

8. Intellectual Property

DNScale OÜ retains all rights, title, and interest in the Postscale platform, including its software, APIs, documentation, designs, and branding.

You retain full ownership of your data, email content, domain configurations, and any content transmitted through the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DNScale OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.

10. Termination

• You may terminate your account at any time with 30 days written notice
• We may terminate or suspend your account immediately for material breach of these Terms, including violation of the Acceptable Use Policy
• We may immediately suspend access if necessary to prevent abuse, spam, or security threats

Upon termination, your right to use the Service ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable legal requirements.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising from these Terms shall be resolved in the courts of Estonia.

If you are a consumer within the European Union, you may also bring proceedings in the courts of your country of residence.
